Family says teacher slammed door on daughter's finger

A student's family is demanding answers filing a federal lawsuit against Hazel Park schools. 

A teacher is accused of slamming a student's finger in a door causing serious damage. 

Serenity, 9, is enjoying her summer vacation but her mom says things haven't been the same for her since a paraprofessional at Webb Elementary school allegedly slammed a metal door on her finger last fall.

"I got a phone call from the school principal stating that something really bad happened to Serenity's finger," said Kenette Wadley, the girl's mother. "I got into my car, went to the school, but before I got there I got a phone call that they have to leave, they have to take Serenity to the hospital. She was (going to be) at Beaumont."

Attorney Jonathan Marko has filed a lawsuit in federal court against the Hazel Park School District even though Webb Elementary is in Ferndale, it is considered part of the Hazel Park school system

"I filed this in federal court because not only is there state law claims for being reckless, there are constitutional violations," Marko said. "She has a constitutional right to be free from this type of behavior while she goes to school."

Serenity is left-handed, it was the index finger on her left hand that injured.  The girl has ADHD and her mom says she does have behavioral issues.

"Before all this escalated I should have gotten a phone call then," said Wadley. "Because any other time they call. None of that should have happened.

"It is unacceptable, there is no way her finger should have gotten slammed in that door."

Wadley and her attorney say they don't know if the door slamming on Serenity's finger was accidental or intentional and they say either way it should have never happened.

"Not only were they negligent, they were reckless," Marko said. "You don't slam a metal or large door on a young girl's hand - you just don't do that. Especially someone you know has learning disabilities and who you know is trying to exit the room."

The Hazel Park school district did not return our phone call.
