Woman who shot at Home Depot shoplifter charged with misdemeanor

A woman who shot at an alleged shoplifter at an Auburn Hills Home Depot will be charged with a misdemeanor.

The shopper, 46-year-old Tatiana Duva-Rodriguez, had a valid concealed pistol license for her gun, and fired at the suspect's vehicle Oct. 6. The man driving the vehicle was not hit, but one of his tires was.

Two days later, the alleged getaway car driver is arrested and charged with retail fraud. The next day, the alleged shoplifter is caught. But the cops say a lineup is needed to positively identify him. 

Also charged - the shopper who tried to help. Rodriguez is charged with reckless discharge of a firearm, a 90-day misdemeanor.

"You do not fire a gun unless it’s in defense of yourself or in the defense of others," said Jessica Cooper, Oakland County prosecutor.

Opinions seem divided on if Rodriguez should be charged.

"She's a good Samaritan because she was acting as an off-duty policeman without having the degree," said Jackie Hanen.

"At least somebody's standing up," said Danielle Mundinger. "A lot of people in circumstances like that would have just walked away."

But some say you don't shoot into a parking lot with people there.

"I agree with the charges," said one man who is a CPL holder from Farmington Hills. "I think she was being pretty reckless, the classes and training you need for a CPL, all teach you to not be doing something like that."

Cooper agrees.

"That is reckless discharge of a firearm which is what she was charged with," she said.

Out on bond, Rodriguez's next court date is Oct. 26.
